Description of Service
Pelto sell high quality limited edition prints, photographed by Anthony Peltohaka, Aka Pelto. His current collection of images are from the “Red Earth, Raw Hide and Ruddy Flies” Exhibition which are installation photographs of cow hide covered surfboards taken in the outback Australia.
Delivery
You understand, agree and acknowledge that Pelto does not guarantee a time frame for completion and delivery of the purchased framed Print. Delivery times frames many vary and are used only as a guide.
From confirmation of purchase and delivery for the following;
Limited Edition Print only – 2 to 4 weeks.
Limited Edition Print with framing 8- 10 weeks.
International delivery times frames may vary and customer will be informed once order is place and delivery is calculated.
Billing Policy
Pelto charge 100% upfront for limited edition print and framing. Delivery cost is calculate when order is confirmed and delivery details are supplied. Customer will be charged for delivery as a separate transaction.
Pelto reserves the right to change prices at any time.
Electronic Signatures
Selecting and submitting “accept” on the electronic copy of the Agreement, submitting content through, making payment, or submitting information or documents to Pelto so that Pelto may perform services or provide product for you is confirmation and a binding contract to employ Pelto products and or services.
Termination/Cancellation
Pelto, allow 24hrs for change of mind. After this time orders can not be cancelled. You agree that all fees incurred and billed prior to cancellation effective date are valid and you agree to pay Pelto.
Requests for cancellation of services should be sent via email to sales@pelto.com.au within the appropriate time frame specified. It is your responsibility to secure confirmation from Pelto that the request for termination has been received and no further service fees will be billed
Privacy
As a condition to using the Service, you agree to the terms of the Pelto Privacy Policy as it may be updated from time to time. Pelto understands that privacy is important to you. You do, however, agree that Pelto may monitor, edit or disclose your personal information, including the content of your correspondence with us, if required to do so in order to comply with any valid legal process or governmental request (such as a search warrant, subpoena, statute, or court order), or as otherwise provided in these Terms of Service and the Pelto Privacy Policy. Personal information collected by Pelto may be stored and processed Australia or any other country in which Pelto. or its agents maintain facilities. By using Pelto, you consent to any such transfer of information outside of your country.
Limitation of Liability
You understand and agree that Pelto, it’s subsidiaries, affiliates, officers, and employees shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, (even if Pelto has been advised of the possibility of such damages). Such limitation of liability shall apply whether the damages arise from the use of or inability to use Pelto products, reliance on Pelto products, or
from the interruption, suspension, or termination of Pelto (including such damages incurred by third parties.) This limitation shall also apply, without limitation, to the costs of procurement of substitute goods or services resulting from products or services purchased or obtained or messages received or transactions entered through Pelto’s services or for unauthorized access to or alteration of your data or transmissions and any statements or conduct of a third party or any other matters relating to dna teams services or products. Such limitation shall further apply, with respect to the performance or non-performance of services or any information or merchandise that appears on, or is linked in any way to Pelto services and or products.
Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above limitations and exclusions may not apply to you.
Without limiting the foregoing, under no circumstance shall Pelto be liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces or causes beyond its reasonable control, including without limitation, internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, or other casualties, illness, accidents, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non performance of third parties, or loss of or fluctuations in heat, light or air conditioning. Pelto full and complete liability, for any reason whatsoever, shall be limited to the full refund of all monies paid to Pelto for that upon authorized returns of goods only.
